Trespassing is defined by accessing someone else’s property without their consent, after either signs of no entry have been posted or consent has been denied. If a person enters someone else’s property, but there are no signs and no verbal warning has been given, the action is not considered as illegal trespassing.

An exception to the rule above is entry onto property that has been fenced. There is no need for a sign or a warning, when there is some sort of protection of the property. If a person deliberately enters a fenced area, the action is considered trespassing, according to the Kansas law.

What can you face?

Even though trespassing is a misdemeanor, and not a felony, the punishments can be up to $1,000 and 30 days in jail, for those being convicted for the first time. Trespassing falls under county jurisdiction in and of itself; however, more often than not, it is connected to additional crimes.

Important message

The fact that the fines and other punishment types are set to a certain level for trespassing doesn’t mean that they cannot be higher. When trespassing is connected to a crime, the civil lawsuit may end up exceeding the limits stated above significantly.
